LEAKED S.£.X TAPE: Let’s Talk Law, Not Just Morals

The internet is boiling over the leaked s*x tape of an Anambra man and woman, who were allegedly married to other people. While opinions are flying everywhere, “They’re divorced!” “No, they’re still married!”, let’s assume they’re both still married for purposes of this discussion.

Now let’s face the real question: Is adultery a crime in Anambra State?

The answer is NO. Let me break it down:

What is adultery?

It’s when a married person has voluntary sexual intercourse with someone who is not their spouse.

But is it a CRIME? No.And here’s why:
A crime is an act made unlawful by a written law, punishable by fine or imprisonment.

In Anambra State, and the entire southern Nigeria, no written law criminalizes adultery.Shocking? Maybe.
Unjust? That’s debatable.But that’s the LAW.

So while adultery might be morally scandalous, it is not legally punishable as a crime in Anambra.

However, in some Northern Nigerian states where Sharia law applies, adultery is a criminal offence, and it carries heavy penalties.

Bottom line?Adultery is a fact if successfully proved could led to divorce but not for jail in Anambra State. Meanwhile, I have written a blog article on adultery and divorce. https://www.elawfirm.ng/adultery-and-divorce-in-nigeria/

So don’t be misled, morality is not always the same as legality.

What do you think? Should adultery be criminalized across Nigeria? Or should it remain a civil (and personal) matter?

Let’s talk in the comments.

I am Ebelechukwu Aroh-Nwoka, your family and property lawyer.

I think it should be criminalized across Naija to curb the excesses and arrogrance of Naija men when it comes to adultery.

I say this as a single woman who has been at the receiving end of far too many advances from married men. Most of them see nothing wrong with adultery, they make all kinds of excuses and arguments, to justify why it is not wrong.

Some will even argue that it is not a sin, it is an expression of love and feelings between a man and a woman. The way we practice this religion in Naija is too much, we over do it, blah blah blah blah. This is the latest argument I heard from a 60 year old married man grin.

I prayed for the salvation of his soul today. A lot of them think the bible is a joke and God is joking when he lists adultery as a sin. Perhaps making it a criminal offence may help to reset or rewire their brains.

Modified to add: Why are this logical gender people like this? Always on the defensive and in attack mode when told the truth or called out on their philandering ways.

One even said I should be humble because I am not the only one who gets advances from married men. As if it is a thing of pride or something to be proud of (just smh and lol)

It is the active lack of discipline and self control majority of you display when it comes to sex, and in particular, sex outside of your marriages, that is appalling.

There's nothing wrong with the desire or temptation itself, but there's everything wrong with the lack of self control most of you display and how hard you try to justify what is wrong. You all be acting like other animals God created with a lesser capacity for logical thought and control.

Law is not enforced so let's forget it.

Nigerians that don't know when not to publish pictures and videos of children are the ones you are talking about for sex. Not everything is law, some things are common sense. For example, foreign media don't show you graphic pictures anyhow because of human dignity. Here, all of us will share the intestine of someone who died in a car crash, then add graphic to the title. It's even done on NL🤡

You were wrong by saying its solely Sharia law that makes adultery ilegal in the North. I believe they have a penal code from Lugard's time that criminalises it and still stands till today.

So, what's your point?, married men do approach you, therefore it's a sin?. You're hiding under a book also written by men. Do you even know if a married man had the consent of his wife to seek another wife ?, haven't you heard women give consent to their husbands?. Better stop the hypocrisy and open your mind before it's too late. Even in the bible, the ones closer to God had more than a wife. Lastly, you're Africa, our culture and traditions predates foreign religion.
